RAPID CITY, S.D. (KOTA) - South Dakota Attorney General Marty Jackley filed a circuit court motion against New York non-profit Mayday Health in an effort to prevent them from advertising in the state.

“Mayday Health is a New York company that has targeted South Dakota for abortion advertisements,” Jackley said. “Those advertisements are deceptive. They’re encouraging a pregnant mother that does have complications after taking the pills they’re advertising to not seek medical treatment from a doctor.”

Jackley sent Mayday Health a cease and desist letter earlier this month after 30 advertisements reading “Pregnant? Don’t want to be?” popped up at Sinclair gas stations around the state.

Mayday Health’s Liv Raisner responded to the letter on social media, arguing Mayday does not sell any pregnancy termination drugs and simply informs people of options.

Nevertheless, Jackley says advertisements promoting illegal activities are illegal themselves.

“It’s no different than if you were to advertise the sale of meth on a billboard,” Jackley said. “You can’t do that. It’s a violation of South Dakota’s deception laws.”

Jackley also mentioned concerns about adverse side effects of using Mifepristone, a drug promoted on the Mayday Health website.
